British Airways App Terms of Use
These App Terms of Use govern your access to and use of the British Airways mobile application (the "App") and should be read together with the Website Terms of Use and Conditions of Carriage.
If you are a member of the Beta Community, your access to and use of certain features or services made available through that programme may be subject to additional terms in accordance with clause 11 (Beta Features). To the extent of any inconsistency between these App Terms of Use and the Website Terms of Use in relation to any feature or functionality specific to the App, these App Terms of Use shall prevail. For the avoidance of doubt, the Conditions of Carriage shall continue to apply in full to any flights or ancillary services booked, purchased or managed through the App.
By downloading, accessing or using the App, and where presented by clicking “Accept”, you agree to be bound by these App Terms of Use. If you do not agree to these App Terms of Use, you must not download, access or use the App.
Terms of Use
The App is owned and operated by British Airways Plc, whose registered office is at PO Box 365, Harmondsworth, UB7 0GB, England ("British Airways", "we", "our" or "us").
Through the App, you may access functionality available on our ba.com website, together with features made available for use on mobile devices, including mobile boarding passes, real-time push notifications and location-based services. We may update, modify or discontinue any functionality from time to time.
We grant you a limited, non-exclusive, non-transferable, revocable licence to download, install and use the App on a compatible device that you own or control, solely for your personal and non-commercial use. This licence is subject to your compliance with these terms.
You must not, and must not permit any third party on your behalf to:
- copy, reproduce, distribute or make available the App or any part of it;
- modify, adapt, alter, translate, reverse engineer, disassemble, decompile or create derivative works from the App, except to the extent that applicable law expressly permits such activity and it cannot be excluded by agreement;
- use the App in any unlawful manner, for any unlawful purpose, or in breach of these terms;
- use any automated system or software to extract data from the App for commercial purposes ("screen scraping");
- interfere with, damage or disrupt the App, its servers, networks or any connected systems.
The App is provided on an "as is" and "as available" basis, without warranty of any kind to the maximum extent permitted by law. We do not warrant that the App will be available, uninterrupted, secure or error-free, or that defects will be corrected.
Functionality may vary depending on your device, operating system, network connectivity and geographic location. We may update, modify, suspend or withdraw the App (or any feature within it) from time to time, including to maintain compatibility, improve functionality, address security issues or for operational reasons. You may need to install updates to continue using some or all features of the App.
The App is currently made available to you free of charge for use on your device. We reserve the right to charge for the App or for any service provided through it at any time, subject to reasonable prior notice.
Where you use the App to search for, book, purchase or manage flights or other services, the Conditions of Carriage and any applicable booking or product-specific terms shall apply.
Use of the mobile boarding pass functionality may require inspection of the boarding pass by British Airways or airport staff, including a requirement for the relevant staff member to handle your device. Whilst all reasonable care will be taken, British Airways accepts no liability for any damage caused to your device during such inspection, except in cases of negligence or wilful misconduct by British Airways staff.
If you enable push notifications, we may send you service-related messages (for example, flight updates, boarding information or disruption alerts) and, where you have consented or where otherwise permitted by applicable law, marketing or promotional communications.
You can manage your notification preferences through your device settings at any time.
The App may request access to certain features of your device (such as location services, camera, contacts or notifications) in order to provide particular functionality.
You may manage these permissions through your device settings. Disabling certain permissions may limit or prevent access to particular functionality within the App.
You must use the App only for lawful purposes and in accordance with these App Terms of Use. You must not use the App in any way that could damage, disable, overburden or impair the App or interfere with any other person's use of the App.
We may suspend, restrict or terminate your access to the App at any time if we reasonably believe you have breached these terms or misused the App, without liability to you.
All intellectual property rights in the App (including the underlying software code, content, database rights, trade marks and branding) are owned by or licensed to British Airways. Nothing in these terms transfers any intellectual property rights to you.
You are granted no rights other than the limited licence expressly set out in clause 2 of these App Terms of Use.
Your use of the App is subject to the British Airways Privacy Policy, available on the Privacy Policy page on ba.com, which explains how we collect, use and share your personal data, including data collected through App-specific functionality such as location services, device information and analytics.
From time to time, certain features or services within the App may be designated as "beta", "preview", "pilot" or "early access" (collectively, "Beta Features"). Beta Features are made available for testing and evaluation purposes only and may not operate as intended. They may contain errors, bugs or inaccuracies, and their availability may be limited, suspended or discontinued at any time without notice.
Beta Features are provided on an "as is" and "as available" basis, without any warranty of any kind, whether express or implied. To the maximum extent permitted by applicable law, British Airways excludes all liability arising out of or in connection with your use of any Beta Feature, including (without limitation) any loss of data, disruption to your travel arrangements or damage to your device.
We may modify, withdraw or replace any Beta Feature at any time. We are under no obligation to release a final or complete version of any Beta Feature. Your use of a Beta Feature does not entitle you to continued access to that feature or to any particular level of functionality.
We may from time to time invite you to participate in user testing, surveys, interviews or other research activities in connection with Beta Features or other aspects of the App ("User Testing"). Participation in User Testing is entirely voluntary. Where User Testing involves the collection of personal data (including usage data, behavioural analytics or your responses to surveys), we will inform you in advance of the types of data being collected, the purposes for which it will be used and the legal basis on which we rely, in accordance with applicable data protection legislation (including UK GDPR Articles 13 and 14). You may withdraw from any User Testing activity at any time without affecting your access to the App or any Beta Feature. Any feedback, responses or data provided through User Testing may be used by British Airways in accordance with the licence granted in clause 12 of these App Terms of Use.
The App may provide functionality that enables you to submit feedback, suggestions, comments or ratings (collectively, "Feedback"). By submitting Feedback, you grant British Airways a non-exclusive, royalty-free, perpetual, irrevocable, worldwide licence to use, reproduce, modify, adapt, publish, distribute and otherwise exploit such Feedback for any purpose, without restriction, attribution or compensation to you.
You acknowledge that Feedback is provided voluntarily and that British Airways is under no obligation to act on, implement or respond to any Feedback received. You must not include any personal data of third parties, confidential information or material that is defamatory, obscene or otherwise unlawful in any Feedback you submit.
The App may allow you to purchase ancillary products or services (such as seat upgrades, additional baggage allowances, lounge access or travel extras) ("In-App Purchases"). All In-App Purchases are subject to the applicable booking terms, Conditions of Carriage and any product-specific terms presented to you at the point of purchase.
Prices for In-App Purchases will be displayed in the App at the time of purchase and are inclusive of applicable taxes unless otherwise stated. Payment will be processed through the payment method you select within the App or, where applicable, through the payment mechanism provided by the relevant app store.
Your rights in relation to In-App Purchases, including any right to cancel or obtain a refund, are governed by applicable consumer protection legislation (including, where relevant, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013) and the specific terms applicable to the product or service purchased.
The App may offer the option to use biometric authentication features available on your device (such as fingerprint recognition or facial recognition) to access certain functionality within the App, such as login or identity verification.
Biometric data processed for this purpose is handled by your device's operating system and is not transmitted to or stored by British Airways. We do not have access to your biometric data. Your use of biometric authentication is entirely voluntary and subject to your device settings.
For further information about how we process personal data in connection with the App, please refer to the British Airways Privacy Policy, available on the Privacy Policy page on ba.com.
We aim to make the App accessible to as many users as reasonably practicable, including users with disabilities. We seek to design and develop the App in accordance with recognised accessibility standards, including the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA (or any successor standard), to the extent reasonably practicable.
If you experience any difficulty accessing or using the App, or wish to provide accessibility feedback, please contact us using the details set out on ba.com. We will use reasonable endeavours to address accessibility issues.
The App includes a chatbot and may include other automated tools or virtual assistants (collectively, "Automated Tools") to assist with common customer service queries, including baggage allowances, flight status, check-in procedures and The British Airways Club queries.
The Automated Tools are designed to assist with frequently asked questions and straightforward service enquiries. Their capabilities may be limited and may not cover all topics or scenarios. We may expand, modify or withdraw their functionality over time. Any enhanced functionality may be introduced gradually and may initially be made available as a Beta Feature (see clause 11).
Automated Tools are provided as a helpful aid. They do not replace human decision-making and are not a substitute for professional or specialist advice. Whilst we endeavour to ensure that the information provided is accurate and up to date, we do not warrant that responses will be complete, accurate, current or error-free. You should independently verify any information received through the Automated Tools before acting on it, particularly in relation to flight schedules, pricing, travel documentation requirements or any matter that may affect your travel arrangements.
The Automated Tools may use artificial intelligence, machine learning or natural language processing technologies. Responses generated by such technologies may be inaccurate or incomplete. The Automated Tools may enable transfer to a human customer service agent during your interaction, either at your request or where the Automated Tool determines that your query would be better handled by a member of our team. If you prefer to contact us directly, our customer service channels are set out on ba.com.
To the extent that the Automated Tools evolve to offer transactional functionality (such as rebooking a flight or amending a reservation), any such actions will be subject to the applicable booking terms, Conditions of Carriage and any product-specific terms. You will always be asked to confirm any transactional action before it is processed. British Airways shall not be liable for any loss or damage arising from your reliance on information or suggestions provided by the Automated Tools, except to the extent caused by our negligence.
We may update, modify or withdraw any Automated Tool (or any functionality within it) at any time without prior notice. We reserve the right to limit or restrict access to certain Automated Tool features based on eligibility criteria, geographic location or other factors.
If you download the App from the Apple App Store or Google Play:
- the relevant app store provider (Apple Inc. or Google LLC, as applicable) is not responsible for the App or its content;
- your use of the App must comply with the applicable app store terms of service;
- Apple Inc. and Google LLC are intended third-party beneficiaries of these terms and may enforce them directly against you;
- in the event of any failure of the App to conform to any applicable warranty, you may notify the relevant app store provider and, to the maximum extent permitted by law, the provider will have no other warranty obligation with respect to the App under these App Terms of Use.
To the maximum extent permitted by applicable law, British Airways shall not be liable for any indirect, special, incidental, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of or in connection with your use of or access to the App, including loss of profit, loss of data or loss of goodwill, whether based on breach of contract, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages.
Nothing in these App Terms of Use shall exclude or limit our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by applicable law.
You agree to indemnify, defend and hold British Airways harmless from and against any liability, loss, claim, demand and expense (including reasonable legal fees) arising out of or in connection with your breach of these App Terms of Use or your misuse of the App.
We may suspend, modify or withdraw access to the App at any time, including where necessary for maintenance, security or operational reasons, without prior notice and without liability to you, subject to applicable law.
Upon termination, the licence granted in clause 2 will cease and you must delete the App from your device.
We may amend these App Terms of Use from time to time as the App evolves. Where we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App following any amendment constitutes your acceptance of the revised terms.
These App Terms of Use, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have non-exclusive jurisdiction.
All other terms relating to your use of British Airways services, including matters not specifically addressed in these App Terms of Use, are set out in our Website Terms of Use and Conditions of Carriage.
If any provision of these App Terms of Use is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
