British Airways Christmas prize draw – full Terms and Conditions

1. Eligibility

1.1 This prize draw is only open to Eligible Participants. An Eligible Participant is a person resident in the United Kingdom (excluding Northern Ireland), aged 18 years or over (or such age as it required for British Airways or BA to lawfully contract with you in the jurisdiction in which you are resident), who has a valid Facebook account and is not an employee of BA, Ogilvy, their group companies, their families, agents or anyone else professionally connected with this prize draw. BA reserves the right to verify the eligibility of Eligible Participants. By taking part in this prize draw, Eligible Participants confirm that they accept the terms and conditions set out below.

2. Conditions of entry

2.1 To enter this prize draw, an Eligible Participant must simply write in the comments section below the Christmas Crackers Facebook post on the BA Facebook page, which friend or family member they would like to pull a cracker with this Christmas (“Travel Companion”). They must successfully post the comment between 6th December 2017 at 00.01 GMT and 23.59 GMT, 12th December 2017. No late entries will be accepted. The Travel Companion must be aged 18 or over and reside in the United Kingdom (excluding Northern Ireland). These terms and conditions apply to both the winner and their Travel Companion references to the winner include (where the context permits) the Travel Companion. Any entries which BA, in its sole discretion, deems offensive or inappropriate will be disqualified.

2.2 By submitting its information and creating a Facebook account, the Eligible Participant agrees to the Facebook terms and conditions, including but not limited to Facebook terms of use and privacy notice (“Facebook Terms and Conditions”). If the Eligible Participant does not agree to the Facebook Terms and Conditions the Eligible Participant cannot use or create a Facebook account and therefore you will not be eligible to participate in this prize draw.

Entries must be made from Facebook accounts that are open to the public.

2.3 The winners will be selected by a random prize draw of Eligible Participants who successfully commented on the Christmas Cracker Facebook post on BA Facebook page pursuant to Clause 2.1.

2.4 No purchase is necessary.

2.5 Only one entry per Eligible Participant is permitted and BA reserves the right to wholly disqualify any person who attempts to enter more than once . No third party or bulk entries are permitted.

2.6 The winners will be contacted by direct Facebook message (“Facebook Message”) shortly after the prize draw (no later than 28 days after the prize draw). Winners must confirm their acceptance of the prize in writing, or by telephone in the method specified in the Facebook Message. If the winners do not claim their prizes within 7 business days from the date the Facebook Message was sent by BA or if the winners decline their prizes, supplementary winners may be drawn from the remaining entries at BA's discretion and will be notified via Facebook Message.

2.7 Winners will be asked to confirm the identity of their Travel Companion and provide some information about their Travel Companions including but limited to their email address and postal address for the purposes of redeeming their prize. Winners undertake that they will obtain the consent of their Travel Companion prior to providing such information to BA and that they will obtain the consent of their Travel Companion to act on their behalf.

2.8 BA accepts no responsibility for damage or loss resulting from misdirected or incomplete entries BA has no responsibility for any malfunction, delay, loss or damage caused by the Facebook website, its malfunction, or the actions of its administrators. BA is in no way liable for the reproduction or indirect access via third party web sites or home page access or where any reproduction misstates or omits any of the information or terms and conditions connected with the prize draw.

3. Prizes

3.1 The prizes available are as follows:

• Five (5) British Airways Gold Cards. For the avoidance of doubt, this will be limited to one Gold Card for each winner (“Gold Card Prize(s)”) in accordance with the provisions of Clause 3.2;
• Five (5) lots of 200,000 Avios which will be allocated as 100,000 Avios for a winner and 100,000 Avios for their Travel Companion, (“Avios Prize(s)”) in accordance with Clause 3.3;
• Ten (10) BA Holiday vouchers of a value of £2,000 each inclusive of VAT. For the avoidance of doubt, one voucher will be issued by winner, (“Voucher Prize(s)”) in accordance with Clause 3.4; and
• Four (4) Return flights in Club World from London Heathrow to New York JFK. For the avoidance of doubt this will be limited to one return flight for a winner and one return flight for their Travel Companion (“Flight Prize(s)”) in accordance with Clause 3.5.

For the avoidance of doubt, prizes are limited to one per winner and their Travel companion (to the extent applicable) and shall not be cumulative or transferable. Prizes will be allocated randomly; winner cannot choose their prize.

3.2 Gold Card Prizes

3.2.1. Winners must become members of the British Airways Executive Club and do so by registering via the unique URL which will be provided to the winner in the Facebook Message notifying them that they have won in accordance with Clause 2.6.

3.2.2. If the winners are existing Executive Club members then the winners will need to reply to the Facebook Message with their correct Executive Club number; in accordance with the paragraph above with their correct Executive Club number.

3.2.3. British Airways will not be liable for Gold Cards being issued against the wrong account and British Airways will not re-issue these Gold Cards to the correct account if incorrect Executive Club numbers are supplied.

3.2.4. One Gold Card will be issued against the British Airways Executive Club account of each of the five winners within 28 days from the date on which the winners register as British Airways Executive Club Member or provide their Executive Club numbers if they are existing members. All Gold Cards issued will be valid for a period of 12 months from date of issuance by BA. At the end of such period, existing Executive Club members will revert back to their previous Executive Club status. New members will revert to the Blue Executive Club status.

3.2.5. In the event that an existing Gold Executive Club member wins a Gold Card, BA at its sole discretion may offer such member an alternative prize but shall be under no obligation to do so.

3.2.6. For the avoidance of doubt, the Gold Card Prize includes the Gold Executive Club Membership card only and is subject to the Executive Club Terms and Conditions available at https://www.britishairways.com/en-gb/executive-club/terms-and-conditions.

3.3 Avios Prizes

3.3.1. Winners and their Travel Companion must become members of the British Airways Executive Club to redeem the Avios Prize and do so by registering via the unique URL which will be provided to the winner in the Facebook message notifying them that they have won in accordance with Clause 2.6. Their Travel Companion will be provided with their unique URL by email at the address provided by the winner in accordance with Clause 2.7.

3.3.2. If the winners and their Travel Companion are existing Executive Club Members then: (i) the winners will need to reply to the Facebook Message with their correct Executive Club Number; and (ii) their Travel Companion will need to reply to the email sent by BA in accordance with the paragraph above with their correct Executive Club Number.

3.3.3. British Airways will not be liable for Avios being credited to the wrong account and British Airways will not be responsible to re-credit these Avios to the correct account if incorrect Executive Club numbers are supplied.

3.3.4. 100,000 Avios will be credited to the British Airways Executive Club account of the winner and 100,000 Avios will be credited to the British Airways Executive Club account of their Travel Companion within 28 days from the date on which the winner and their Travel Companion register as British Airways Executive Club Members or provides their Executive Club numbers if they are existing members.

3.3.5.The winner and their Travel Companion should be aware that in accordance with these Terms and Conditions and the Avios Conditions of Use: if Avios Points are not earned or redeemed or purchased or transferred for 36 consecutive months, all Avios Points that have accrued to that date will expire. BA does not accept any liability in the event that the winner’s Prize expires.

3.3.6. British Airways Executive Club Terms and Conditions and the Avios Conditions of Use will apply.

3.4 Voucher Prizes

3.4.1. The Voucher Prize can be used against holidays (flight and hotel, flight and car, hotel or car only, experiences, transfers) available on ba.com.

3.4.2. Voucher Prize is only valid for travel between 1 January 2018 and 31 December 2018 to any BA Holiday packages. All trips are subject to availability at the time of booking.

3.4.3. The winner is required to contact BA in order to make their booking at the email address provided by BA and BA will book their holiday package on behalf of the winner, subject to availability. For the avoidance of doubt, the winner cannot book their holiday package directly.

3.4.5. Winners can add extra value by adding their own payment if wishing to choose a trip in excess of the Voucher Prize value. No refund will be provided for trips of less than the Voucher Prize value (each Voucher Prize can only be used be once)..

3.4.6. The Voucher Prize is not transferable and no cash or credit alternatives will be offered.

3.4.7. Winners may only choose their flight prize from BA operated flights. Travel on BA franchise, code-share and alliance airlines, domestic connections, transfers and other add-ons are not included. Once booked, no changes can be made to the Voucher Prize.

3.4.8. All travel on BA flights is subject to BA’s General Conditions of Carriage for Passengers and Baggage available on ba.com and the notice and conditions of contract contained on each flight ticket and itinerary.

3.4.9. The winner will be responsible for all insurance, visa if necessary and spending money. All other Terms & Conditions are as per the holiday product booked. The winner is responsible for supplying valid passports and visas and obtaining inoculations that may be required to visit the destination that is their Voucher Prize. BA recommends that all passengers consider travel and medical insurance prior to commencing any flight.

3.4.10. Flights cannot be upgraded, transferred, sold or exchanged. For the avoidance of doubt, winners are responsible for any additional expenses, including but not limited to transportation to and from the airport and all incidental expenses.

3.4.11. BA Holidays booked using the Voucher Prize will not earn Avios.

3.5 Flight Prizes

3.5.1. The Flight Prize is valid for travel between 1 January 2018 and 31 December 2018 (“Travel Period”) only and is subject to availability at the time of booking. The winner (on their own behalf and on behalf of their Travel Companion) may book the Flight Prize at any time provided that (i) the Flight Prize is within the Travel Period; (ii) the winner informs BA of their preferred flying dates by email no later than 30 business days prior to their preferred flying dates. BA reserves the right to refuse to issue the Flight Prize for the winner’s preferred flying dates in the event that the winner fails to inform BA within this specified period and request that the winner proposes alternative preferred flying dates.

3.5.2. BA reserves the right to limit the number of prize travel seats available on any flight. It is possible that there will be no prize travel seats allocated on a particular service or the flight may be fully booked for prize travel seats, even though other seats are still available in the same cabin. BA does not accept any responsibility in the event that the winner is unable to obtain their preferred flight(s).

3.5.3. Both flights comprised in the Flight Prize must be redeemed at the same time by the winner on their own behalf and on behalf of their Travel Companion and cannot be split. Both flights comprised in the Flight Prize must be used on the same journey, on the same day and on the same flights.

3.5.4. Where available Flight Prize may be issued as e-tickets. All transportation taxes, fees and charges are included. Flight Prize cannot be upgraded, transferred, sold or exchanged. For the avoidance of doubts, winners are responsible for any additional expenses, including but not limited to transportation to and from the airport and all incidental expenses. In addition, the winner is responsible for any income or use tax assessed in connection with the prize.

3.5.5. The winner and his/her travelling companion are responsible for supplying valid passports and visas and obtaining inoculations that may be required to visit the destination that is their prize. BA recommends that all passengers consider travel and medical insurance prior to commencing any flight.

3.5.6. Winners may only choose their flight prize from BA operated flights. Travel on BA franchise, code-share and alliance airlines, domestic connections, transfers and other add-ons are not included. Once booked, no changes can be made to the flight prize.

3.5.7. All travel on BA flights is subject to BA’s General Conditions of Carriage for Passengers and Baggage available on ba.com and the notice and conditions of contract contained on each flight ticket and itinerary.

3.5.8. Flight Prizes will not ear Avios.

4. General

4.1. BA reserves the right to provide substitute prizes of similar value, should the specified prizes become unavailable for reasons beyond its control.

4.2. No cash or credit alternatives are offered. All third party terms and conditions relating to the prize apply.

4.3. The prize draw is in no way sponsored, endorsed or administered by, or associated with, Facebook. You are providing your details to BA and not to Facebook.

4.4. The winner and their Travel Companion where applicable is responsible for any income or use tax assessed in connection with the prizes.

4.5. BA’s decision is final and no correspondence will be entered into. BA reserves the right to cancel or amend without notice the terms of this prize draw and any flight tickets issued in the event of major catastrophe, war, earthquake or any actual or anticipated or alleged breach of any applicable law or regulation or any other circumstance beyond BA’s control in its sole discretion. BA reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the promotion or to be acting in violation of these Terms and Conditions or any other promotion or in an unsportsmanlike or disruptive manner.

4.6. Except where prohibited, participation in the promotion constitutes the winner’s (and travel companion’s) consent to BA’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration and you confirm that you will obtain from any guest whom you invite permission for the promoters to use their name and likeness, for advertising and future promotional purposes without additional compensation.

4.7. For a list of winners, names, please send a stamped self-addressed envelope after 3 months after the prize draw to brand and marketing team (FAO Christmas campaign), at BA’s address as provided at Clause 4.11 below.

4.8 Flight prizes cannot be used in conjunction with any other discount, discount coupon(s) or voucher(s), promotion(s), or special offer(s), by BA or jointly with any other organisation, bonus, awards or certificates. No Avios or partner miles will be awarded for travel under this prize draw.

4.9. Promotional materials form part of these terms and conditions. These Terms and Conditions will prevail in the event of any conflict between these and the promotional materials.

4.10. This prize draw is governed by and construed in accordance with the law of England and Wales. By taking part in this prize draw, you agree to be bound by these laws.

4.12. 4.4. Personal data will be taken where necessary from all entries received but shall be limited to those details reasonably necessary for the administration of the prize draw.
