Participation in the UnGrounded program is by invitation only. The invitation to participate in the UnGrounded program is not transferable and no guests are permitted. Full UnGrounded program details will be provided prior to travel.
The UnGroundedprogram consists of a chartered flight departing from San Francisco, CA (“SFO”) on the 12th of June 2013 at14:55 PDT, arriving at London, England (“LHR”) on the 13th of June 2013 and attendance at the DNA summit on the 14th of June2013 in London, England.
Participants are responsible for transportation arrangements to SFO airport on the 12th of June 2013.
Participants are responsible for supplying a valid passport and visa and obtaining inoculations that may be required to visit Great Britain. British Airways recommends that all participants consider travel and medical insurance prior to commencing any flight. Participants must be 21 y.o. or older on the 12th of June 2013.
Seat selection on the outbound chartered flight will be determined by British Airways. First Class and Business Class Seats are limited and not all participants will be assigned a First Class or Business Class seat.
British Airways will supply hotel accommodation fortwo (2) nights whilst in London (the 13thand 14thof June) at a hotel of its choice. Participants will not necessarily be staying at the same hotel. Participants are solely responsible for any and all in-room charges (e.g. mini-bar, room service, laundry services, telephone calls, internet usage, movie rental, etc.). All transportation in England, including to and from LHR and to and from the DNA summit will be the individual responsibility of each participant.
British Airwayswill provide a return flight for travel no later than the 31st of July 2013. British Airways will not provide any return flights after this date.Return flights must be booked through our booking agent Lime. If participant does not accept any of the return flights offered by British Airways, the participant will be responsible for providing their own return transportation. All return flights must be to a United States gateway on a British Airways operated flight - travel on British Airways franchise, codeshare, and alliance airlines is NOT included. British Airways is not responsible for any travel upgrades or baggage fees on the return flight. The seat on the return flight will be in Economy. All return flights will be issued as e-tickets. British Airways conditions of carriage will apply. Return flights cannot be changed once booked. Return flights are subject to availability and capacity control. British Airways reserves the right to limit the number of return travel seats available on any flight. It is possible that there will be no return travel seats allocated on a particular service or the flight may be fully booked for return travel seats, even though other seats are still available in the same cabin. British Airways does not accept any responsibility in the event that the participant is unable to book their preferred flight. Return flight are not eligible for denied boarding compensation. Tickets have no cash value and are nonrefundable.The return ticket cannot be combined with any other offer. Other significant restrictions may apply. British Airways will pay all taxes, fees and carrier chargesunless otherwise specified to the individual.
Participants cannot combine outbound or return flight with any other discount(s), coupon(s), voucher(s), promotion(s), award(s), certificate(s) or special offer(s) by British Airways or any other organization. No frequent flyer miles or Avios will be awarded as part of the UnGrounded program.
Any and all additional expenses not specifically provided for in these Terms and Conditions are the responsibility of the participant. British Airways will not reimburse any expenses not covered by these Terms and Conditions.
British Airways will be sharing your details with our booking agent Lime, who will contact you directly to book your return flight. Details will also be shared with the hotel in London to secure your hotel room for the duration of the stay.
British Airways reserves the right to modify or change these Terms and Conditions without notice.
By clicking the submit button, participants fully and unconditionally agree to be bound by these Terms and Conditions, which will be final and binding in all matters relating to the UnGrounded program. By participating in UnGrounded, participant agrees to the use of their name, address (city and state), photograph, picture, portrait, voice, likenesses, biographical information, and/or statements for purposes of advertising, trade, or promotion in any media (now known or hereafter known) throughout the world in perpetuity, without further compensation, notification or permission, unless prohibited by law. Nothing contained herein shall be deemed to obligate British Airways or DNA to make use of any of the rights granted herein and the participant waives any right to inspect or approve any such use of any and every nature and kind. Furthermore, all output, including but not limited to ideas and work product that stems from the UnGrounded program, is the sole property of British Airways. British Airways may use this intellectual property as it sees fit, without notice or consultation.
By participating in the UnGrounded program, the participant agrees that the officers, directors and employees of British Airways and DNA and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, (all such individuals and entities collectively referred to herein the “Released Parties”) shall not be responsible or liable for any losses, damages or injuries of any kind (including death) resulting from participation in the UnGrounded program or any program-related or travel-related activity, or from participants’ acceptance, receipt, possession, and/or use or misuse of any program materials, and (b) have not made any warranty, representation or guarantee, express or implied, in fact or in law, with respect to any program materials, including, without limitation, to such program material’s quality or fitness for a particular purpose.
IN NO EVENT WILL THE RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE UNGROUNDED PROGRAM. IN NO EVENT SHALL THE RELEASED PARTIES’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED $100. WITHOUT LIMITING THE FOREGOING, THE FLIGHTS AND PROGRAM MATERIALS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
Participants waive all rights to trial in any action or proceeding instituted in connection with these Terms and Conditions. Any controversy or claim arising out of or relating to these Terms and Conditions shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in New York, New York.
These Terms and Conditions shall be governed by and construed in accordance with the laws of New York without regard it its conflict of laws rules. For any matters which are not subject to arbitration as set forth in these Terms and Conditions and/or in connection with the entering of any judgment on an arbitration award in connection with these Terms and Conditions, the participants irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the county of New York in the state of New York. The participants agree not to raise the defense of forum non conveniens.
